Direct Compensation Agreement (DCA): an indispensable tool

  • The Direct Compensation Agreement has proven to be indispensable in simplifying claim settlement.
  • The principle governing direct compensation is the following: each driver is compensated directly by his or her own insurer and the liability of each party involved in an accident is established by the insurer using the Driver's Fault Chart.
  • The Chart reproduces virtually every accident scenario and has undergone numerous revisions to incorporate new jurisprudence and the many amendments made to the Highway Safety Code.
  • The principle of direct compensation also resulted in insurers waiving their right of subrogation. Long gone are the negotiations and lawsuits aimed at making the insurer of the party responsible for the damages incurred reimburse the insurer of the party not responsible for the damages suffered by his or her client. Introducing this practice has simplified every one's life and, in turn, significantly reduced delays and file closing costs.
